The Commission issued an Order today (04/17/08) stating that if TrAILco wants the Commission to review the Joint Stipulation,they must file a revised motion to toll to allow time for the Commission to schedule and convene a hearing to receive testimony and/or argument from all respondents in the case before issuing a final decision, establishing a statutory deadline of at least 12:01 A.M., August 2, 2008. Upon receipt of the motion, the Commission intends to issue a further procedural order.
With attorneys in the Virginia case set to file their briefs on May 19, 2008, we had hoped West Virginia would render their decision by the May 2 deadline that was established at the close of the WV hearings this past winter. By all accounts, there was good reason to believe the WV PSC might deny approval of the line.
